Do I need a lawyer to buy a home in Spain?

When you're dealing with a foreign language, different culture and an alien bureaucracy it's absolutely vital to employ the services of a reputable Lawyer who understands the system and will protect your interests throughout the property transaction.

What is an N.I.E number?

The N.I.E. is a foreigner's identification number. All foreigners living in Spain must apply for this number.

Will I have problems getting a mortgage?

Subject to criteria, mortgages are available and are usually granted more readily than in the UK. Mortgages can be granted for up to 70-80% of the property and over a period of 5 - 25 years, depending on age and status. The documents you will need when applying for a mortgage are:

  • Income tax return (P60 form)
  • Proof of earnings (last 3 pay slips, pension statement)
  • Copy of passport

For Self-employed persons a copy of certified accounts must be available.

There will be a charge made to you by whichever bank you choose to use to set up your mortgage. This charge can vary from bank to bank and it is always wise to request a full breakdown of costs prior to agreement.

What additional costs should I be aware of?

When buying your property in Spain you will incur costs that you would find a bit of a shock if you were not informed about them prior to buying.  Some Agents will give you an "All Inclusive" price which should (but doesn't always) include all of these costs. We prefer to take a more up-front approach by breaking down and listing all of the matters that will come into play. This way you will have a firm idea of what you will need to pay

    • Changing over of water and electricity contracts

N.B. The legal fees above when buying without a mortgage should never be more than 2200 euros whether the house value be 50,000 euros or 500,000 euros. As mentioned above, when a mortgage is to be set up there will be a charge made to you by the bank. Please note that as you will see in our all inclusive, this is way below the 10% often quoted.

How easy will it be to sell my property?

Can I set up a Spanish will?

Property owners are strongly advised to make a Spanish will, an uncomplicated process as it is in the UK. This can be arranged by our legal representative for your sale.

What is the Padron?

If you live in Spain for more than six months, you must sign on the local Town Hall register (Padron). To register, you will need your title deeds (Escritura) or utility bill and your passport. Registering is required by your local town hall as a method of calculating the needs of Doctors, Police, Schools and various other local services.

How do I apply for permanent residence (Residencia)?

The documents that you need to apply for Residencia are:

  • passport
  • photographs
  • proof of monthly income or pension
  • proof of private health insurance or E121 form

Will getting my child into a school be a problem?

Spain offers many bilingual schools - English, Norwegian, as well as free Spanish state schools.

How about bringing my own car over to Spain?

This is not a problem - however you must transfer your vehicle onto Spanish plates if staying for longer than six months.

What documents do I have to carry in my car?

What social activities will I find in Spain?

You will find that the area has a large variety of nationalities. There is a very strong English-speaking community within the area and most clubs; social activities such as bowls, local societies that you would find in the UK are located here.

Will my home be secure?

As at home many companies offer a 24h security response alarm systems which are reassuring and a good deterrent. Door and window grills also offer an alternative and are both popular and decorative.

What is access to television like in Spain?

All of the home comforts you are accustomed to are available; digital TV (sky, BBC, ITV, ETC) as well as Spanish language TV.

How good is the public transport?

There is easy access to local buses and a wide availability of taxis. Public transport in Spain is very reasonably priced.

Can I bring my pet(s) with me?

Yes, but your pets must be fully vaccinated at least one month prior to



arriving in Spain. Consult your veterinarian at your earliest opportunity.
